The Billion-Dollar AI Settlement: Anthropic Pays $1.5B to Authors

The Billion-Dollar AI Settlement: Anthropic Pays $1.5B to Authors back to blog SEPTEMBER 2025 Sources: Intellectual Property in 2025: News round-up (Lawdit Solicitors, Sep 2025) The Event: September 2025 marked a turning point in the “AI vs. Creators” war. Anthropic, the AI startup behind the ‘Claude’ models, agreed to a massive $1.5 billion settlement with a class of authors and publishers. The lawsuit alleged that Anthropic used pirated versions of copyrighted books—sourced from “shadow library” datasets—to train its models without license or payment.   Simultaneously, Encyclopaedia Britannica and Merriam-Webster filed a new lawsuit against Perplexity AI, accusing the search engine of scraping their content to generate summaries that effectively compete with the original sources.   Why This Matters: This is the first time a major AI lab has paid out a settlement of this magnitude. It signals that the “Fair Use” defense for training data is cracking under legal pressure. For businesses using AI tools, this raises critical questions about the “IP hygiene” of the models they rely on.   How ASEAN IPR Helps: Are you using AI tools to generate marketing copy or code? If the underlying model is sued for infringement, your output could theoretically be at risk. ASEAN IPR advises companies on “AI Risk Mitigation.” We review your vendor contracts and indemnify clauses to ensure your business is insulated from the upstream copyright battles of Big Tech. Bollywood vs. Bots: Historic “Deepfake” Rulings in India back to blog OCTOBER 2025 Sources: Intellectual Property Rights October 2025 Roundup (SCC Online) Wu-Tang Clan’s “Trade Secret” Album Ruling (Dentons Link Legal, Oct 2025) The Event: In October 2025, courts in India set a global precedent for “Personality Rights” in the age of AI. The Delhi High Court and Bombay High Court issued landmark injunctions protecting Bollywood superstars Hrithik Roshan and Akshay Kumar from unauthorized AI clones.   The courts restrained multiple platforms from using AI deepfakes to create unauthorized endorsements. In a novel move, the Bombay High Court ruled that even a “voice clone” or a “digital avatar” constitutes an infringement of the actor’s personality rights and trademarked name, ordering platforms like Meta and Google to scrub the infringing content immediately.   The “Wu-Tang” Trade Secret: In a stranger twist, a US Federal Court ruled this month that the Wu-Tang Clan’s unreleased album, Once Upon a Time in Shaolin, qualifies as a Trade Secret. Because only one physical copy exists and it was sold with strict non-disclosure terms, the court found its value derived specifically from its secrecy—expanding the definition of trade secrets into the music industry.    How ASEAN IPR Helps: The line between “fan art” and “infringement” has vanished. ASEAN IPR helps celebrities and influencers in Southeast Asia enforce their Personality Rights. If your likeness is being used by an AI generator or a deepfake scam, we use these new legal precedents to issue immediate takedown notices to platforms operating in the region. Global Design Law Unites: WIPO Treaty Adopted in Riyadh

Global Design Law Unites: WIPO Treaty Adopted in Riyadh back to blog NOVEMBER 2025 Sources: WIPO Diplomatic Conference on Design Law Treaty (WIPO Official, Nov 2025) UPC Update: November 2025 (Mishcon de Reya) The Event: On November 22, 2025, the global IP community gathered in Riyadh, Saudi Arabia, for the conclusion of the WIPO Diplomatic Conference. The result was the historic adoption of the Design Law Treaty (DLT). The DLT aims to harmonize the procedural requirements for registering industrial designs across borders. Previously, designers faced a nightmare of different photo formats, description requirements, and bureaucratic hurdles when filing in multiple countries. The new treaty standardizes these formalities, making it significantly cheaper and faster for designers to protect their creations globally.   European Update: In Europe, the Unified Patent Court (UPC) continued to flex its muscles. In November, the Hague Local Division confirmed its “Long-Arm Jurisdiction,” ruling that it could issue decisions covering patents in non-EU countries if the defendant is based outside the UPC zone, further strengthening the court’s power.     How ASEAN IPR Helps: Design protection is often the most overlooked asset. With the new DLT making cross-border registration easier, ASEAN IPR helps you audit your product designs. We prepare your filings to meet the new standardized WIPO formats, ensuring that your unique product look is protected not just in ASEAN, but in all DLT signatory nations.
