Guide To Trademark Prosecution in Brunei

1. Search & Clearance Brunei operates on a strict “First-to-File” basis. We conduct comprehensive searches of the BruIPO register to ensure your mark is available and does not infringe on prior rights.

2. Application Filing We handle the filing of your application (Form TM1) with BruIPO. Brunei is a member of the Madrid Protocol, allowing for international designation, though direct national filings often provide faster resolution for local disputes.

  • Requirement: A clear representation of the mark and a list of goods/services classified under the Nice Classification.

3. Examination BruIPO conducts two stages of review:

  • Formal Examination: Checks for administrative compliance.

  • Substantive Examination: Assesses the mark for distinctiveness and conflict with prior marks. If an objection is raised, we have a specific window to file a written submission.

4. Publication & Opposition Once the registrar accepts the mark, it is published in the Trade Marks Journal.

  • Critical Window: Third parties have 3 months from the date of publication to file an opposition. This is longer than in many ASEAN neighbors, requiring extended monitoring.

5. Registration & Renewal If no opposition is filed, the Certificate of Registration is issued.

  • Validity: 10 years from the filing date.

  • Renewal: Renewable every 10 years indefinitely.

Guide To Patent Prosecution in Brunei

1. Filing the Application We manage the filing of your patent specification. You can enter Brunei via the PCT National Phase (deadline: 30 months from priority date) or the Paris Convention (deadline: 12 months).

2. Publication Your application is published in the Patent Journal 18 months after the filing or priority date, making it available for public inspection.

3. Request for Search & Examination Action Required: Examination is not automatic. We must file a request for Search and/or Examination:

  • Search Request: Due within 13 months of priority date.

  • Examination Request: Due within 21 months of priority date.

  • Efficiency Strategy: We can often rely on the final search and examination results from a prescribed foreign patent office (like UK, USA, or EPO) to accelerate the Brunei grant.

4. Grant of Patent Once the formalities and examination requirements are met, the Certificate of Grant is issued.

  • Validity: 20 years from the filing date.

5. Annuities (Maintenance Fees) To keep the patent valid, annual fees must be paid.

  • Payment Schedule: Annuities are payable starting from the 5th year onwards from the filing date.
