1. Search & Strategy We begin with a comprehensive search of the IPOS register. Singapore operates on a “First-to-File” basis, so establishing priority is critical. We also advise on utilizing the Madrid Protocol if Singapore is part of a wider international filing strategy.
2. Application Filing We handle the precise classification of your goods/services (Nice Classification) and file your application via the IPOS Digital Hub.
Note: If you have a corresponding application in a Paris Convention country, we can claim priority within 6 months of the original filing date.
3. Examination IPOS examiners review the mark for absolute and relative grounds for refusal. If objections are raised, we have 4 months to file a response or amendment to overcome them.
4. Publication & Opposition Once accepted, your mark is published in the Trade Marks Journal. Third parties have a 2-month window to oppose the registration. This period requires close monitoring to ensure your rights are not challenged.
5. Registration & Renewal If no opposition arises, the Certificate of Registration is issued.
Validity: 10 years from the date of filing.
Renewal: Renewable every 10 years indefinitely. Renewals can be filed up to 6 months before expiration.
1. Filing the Application We draft and file your specification with IPOS. You may enter via the National Route or the PCT National Phase (deadline: 30 months from priority date).
Tip: We can utilize the ASEAN Patent Examination Co-operation (ASPEC) to expedite the process if you have corresponding filings in other ASEAN nations.
2. Preliminary Examination IPOS conducts a formal review to ensure all administrative requirements are met. Once cleared, a Date of Filing is accorded.
3. Publication Your application is published in the Patents Journal 18 months after the filing or priority date, making it open to public inspection.
4. Substantive Examination We must file a request for Search and Examination. The examiner assesses the invention for Novelty, Inventive Step, and Industrial Applicability.
Deadline: For domestic applications, the request for examination is generally due within 36 months of the filing/priority date.
5. Grant of Patent Once the examiner is satisfied, a Certificate of Grant is issued.
Validity: 20 years from the filing date.
Maintenance: Annual renewal fees apply starting from the 5th year onwards.
