Thailand offers a robust environment for innovation, but navigating the Department of Intellectual Property (DIP) requires precision. As a “First-to-File” jurisdiction with strict language and procedural requirements, the path to protection can be complex. At ASEAN IPR, we simplify this journey. Our team combines deep knowledge of Thai IP law with regional strategy, ensuring your assets are secured efficiently and positioned to give you a competitive edge in the Kingdom.
1. Search & Clearance Thailand follows a strict “First-to-File” rule. We conduct exhaustive clearance searches through the DIP database to ensure your mark is available and distinct before you invest in filing.
2. Application Filing We manage the preparation and filing of your application. Thailand is a member of the Madrid Protocol, allowing for international applications, though direct national filings often provide greater control over the specification of goods/services to meet local standards.
Requirement: A clear specimen of the mark and a list of goods/services classified under the Nice Classification.
3. Examination The Registrar reviews the application for formalities and distinctiveness. If an objection is raised (a common occurrence for broad specifications), we have 60 days to file a response or argument to overcome the refusal.
4. Publication & Opposition Once accepted, your mark is published in the Thai Trademark Gazette. Third parties have a 60-day window from the publication date to file an opposition if they believe the registration infringes on their rights.
5. Registration & Renewal If no opposition is filed (or if it is overcome), the Certificate of Registration is issued.
Validity: 10 years from the filing date.
Renewal: Renewable every 10 years indefinitely.
1. Filing the Application We handle the drafting and filing of your patent specification in the Thai language. You can enter Thailand via the PCT National Phase (deadline: 30 months from priority date) or the Paris Convention (deadline: 12 months).
Note: Thailand also offers “Petty Patents” (Utility Models) for minor innovations, which have a faster registration process.
2. Publication Your application is published in the Patent Gazette 18 months after the filing/priority date. This opens the application to public inspection and third-party observation.
3. Request for Substantive Examination Critical Step: Unlike many other countries, examination is not automatic. We must file a specific request for Substantive Examination within 5 years from the publication date. Failure to do so leads to abandonment.
4. Substantive Examination The DIP examiner assesses the invention for Novelty, Inventive Step, and Industrial Applicability.
Efficiency Tip: We can submit granted patent results from other major IP offices (like USPTO, EPO, or JPO) to accelerate the Thai examination process.
5. Grant & Maintenance Once granted, the Certificate of Patent is issued.
Validity: 20 years from the filing date for Invention Patents.
Annuities: Annual fees generally start from the 5th year of the patent term and must be paid to keep the patent in force.
