Guide To Trademark Prosecution in Vietnam

1. Search & Clearance Vietnam follows a “First-to-File” principle. We conduct deep clearance searches to ensure your mark is available.

  • Strategic Insight: If a similar mark exists, we can assess the viability of a “Letter of Consent.” Unlike many jurisdictions, Vietnam examiners may accept a letter of consent from a prior owner to overcome a refusal if the marks are similar but not identical.

2. Application Filing We handle the filing of your application with IP Vietnam.

  • Requirement: A clear specimen of the mark and a list of goods/services classified under the Nice Classification.

3. Formality & Publication

  • Formality Exam: Takes approximately 1 month to check for administrative compliance.

  • Publication: Once accepted, the mark is published in the Industrial Property Official Gazette for 2 months.

4. Opposition & Substantive Examination

  • Opposition: Third parties have a fixed 5-month window from the publication date to file an opposition.

  • Substantive Exam: The examiner reviews the mark for distinctiveness. This process typically takes 9-18 months.

5. Registration & Renewal Upon successful examination, the Certificate of Registration is granted.

  • Validity: 10 years from the filing date.

  • Renewal: Renewable every 10 years indefinitely.

Guide To Patent Prosecution in Vietnam

1. Filing the Application We manage the filing of your specification in Vietnamese. You can enter via the PCT National Phase (deadline: 31 months) or the Paris Convention (deadline: 12 months).

  • Strategic Option: For inventions with a shorter commercial life or lower inventive step, we can file for a “Utility Solution” (Petty Patent), which is often granted faster.

2. Publication Your application is published in the Official Gazette in the 19th month from the priority date (or earlier upon request), opening it to public inspection.

3. Request for Substantive Examination We must file a request for substantive examination within 42 months for Invention Patents or 36 months for Utility Solutions. Failure to do so results in the application being withdrawn.

4. Substantive Examination The IP Vietnam examiner assesses the invention for Novelty, Inventive Step (not required for Utility Solutions), and Industrial Applicability.

  • Timeline: The statutory limit is 18 months, though complex cases may take longer.

5. Grant & Annuities Once granted, the patent is valid for 20 years (Invention) or 10 years (Utility Solution) from the filing date.

  • Maintenance: Annuities are paid annually to keep the patent in force.
