The Intellectual Property Office of the Philippines (IPOPHL) enforces strict “use it or lose it” policies. Guide To Trademark Prosecution in the Philippines

1. Search & Filing We conduct a comprehensive search of the IPOPHL database. The Philippines follows a “First-to-File” system, making early filing essential.

  • Note: Unlike some jurisdictions, IPOPHL does not require proof of use at the moment of filing, but it is mandatory later.

2. Application & Examination We file your application with IPOPHL. Examiners review the mark for substantive compliance. If an objection (Office Action) is raised, we have 2 months to file a response to overcome it.

3. Publication & Opposition Once the mark is allowed, it is published in the IPOPHL e-Gazette.

  • Opposition Period: Third parties have a strict 30-day window from the publication date to file an opposition. This is shorter than in many other ASEAN countries, requiring vigilant monitoring.

4. Mandatory Declaration of Actual Use (DAU) CRITICAL: This is unique to the Philippines. To keep your registration alive, we must file a Declaration of Actual Use (DAU) accompanied by proof (labels, receipts, photos) during these strict windows:

  • 3rd Year DAU: Within 3 years from the filing date.

  • 5th Year DAU: Within 1 year after the 5th anniversary of registration.

  • Renewal DAU: Within 1 year of every renewal.

5. Registration & Renewal

  • Validity: 10 years from the date of registration.

  • Renewal: Renewable every 10 years indefinitely, provided all DAUs are filed on time.

Guide To Patent Prosecution in the Philippines

1. Filing the Application We handle the drafting and filing of your specification. You can enter via the PCT National Phase (deadline: 30 months from priority date) or the Paris Convention (deadline: 12 months).

2. Publication Your application is published in the IPOPHL Gazette 18 months after the filing/priority date. This publication opens the application to third-party observations.

3. Request for Substantive Examination Action Required: Examination is not automatic. We must file a specific request for Substantive Examination within 6 months from the date of publication. Failure to do so results in the application being withdrawn.

4. Substantive Examination The examiner assesses the invention for Novelty, Inventive Step, and Industrial Applicability.

  • Efficiency Tip: We can utilize the Patent Prosecution Highway (PPH) or ASPEC to accelerate your Philippine grant if you already have positive results from partners like the JPO, USPTO, or other ASEAN offices.

5. Grant & Annuities Once granted, the patent is valid for 20 years from the filing date.

  • Maintenance: Annual fees (annuities) are payable starting from the 5th year after the publication date.
