Introduction For years, Cambodia’s patent system was known for its leniency. Patent owners often paid renewal fees late with little to no consequence, as the law was not strictly enforced. That era ended abruptly in late 2024. The Ministry of Industry, Science, Technology and Innovation (MISTI) implemented a new regulation that strictly enforces penalties for late patent renewals, a change that is catching many foreign rights holders off guard in 2025.
The New Penalty Structure Effective from August 2024, if you miss your patent renewal deadline, you don’t just pay the fee—you pay a daily penalty. The regulation imposes a daily fine (approx. USD 0.12 per day) for every day the payment is late during the 6-month grace period. While the daily amount seems small, the administrative burden and the strict refusal to process renewals without the exact penalty payment have created a logistical minefield for global portfolios.
No More “Pay Whenever” Previously, proprietors had significant leeway. Now, the system is automated and unforgiving. Failing to pay within the grace period results in the irreversible lapsing of the patent rights. This shift marks Cambodia’s transition from a “developing” IP system to a formal, rule-based regime.
